1. Acceptance of Terms

By accessing or using AIPulse at aipulse.is (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. We will notify you of material changes by posting a notice on the Service. Your continued use after changes are posted constitutes acceptance of the revised Terms.

2. Account Terms

You may create an account using an email address and password, or by signing in with Google OAuth. By creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activity that occurs under your account
• Notify us immediately of any unauthorised access
• Not create multiple accounts for abusive purposes

You must be at least 16 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

AIPulse is a directory, discovery platform, and marketplace for AI tools and digital products. You may use the Service to:

• Browse, search, and compare AI tools
• Read and subscribe to our AI digest newsletter
• Purchase digital products from the marketplace
• Sell digital products through the marketplace
• Submit tool listings for review
• Participate in community features

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or harvest data from the Service without permission
• Attempt to gain unauthorised access to our systems
• Upload malicious code, viruses, or harmful content
• Impersonate another person or entity
• Manipulate ratings, reviews, or Pulse Scores
• Interfere with or disrupt the Service

4. Subscriptions and Payments

AIPulse offers free and paid subscription tiers. Paid subscriptions are billed monthly through Stripe.

Free Tier

Free accounts have access to limited features, including a subset of daily digest articles and basic directory browsing.

Paid Tiers

Paid subscriptions unlock full access to all digest content, advanced features, and premium tools. Pricing is displayed on our Pricing page.

Billing and Cancellation

• Subscriptions renew automatically unless cancelled
• You can cancel at any time through your account settings or by contacting us
• Cancellation takes effect at the end of the current billing period
• We do not offer prorated refunds for partial billing periods
• All prices are in USD unless otherwise stated

5. Marketplace Terms

The AIPulse Marketplace allows sellers to list and sell digital products (such as courses, guides, and templates) to buyers.

For Sellers

• You retain ownership of the content you upload and sell
• By listing a product, you grant AIPulse a non-exclusive licence to display, distribute, and promote your product on the platform
• AIPulse charges a 10% commission on each sale, deducted before payout
• You are responsible for the accuracy of your product descriptions
• Products must not contain malware, illegal content, or infringe on third-party intellectual property
• AIPulse reserves the right to remove listings that violate these Terms

For Buyers

• Digital products are delivered electronically upon successful payment
• Due to the nature of digital goods, all sales are final unless the product is materially different from its description
• If you believe a product is defective or misrepresented, contact us within 14 days of purchase for review
• Purchased products are for your personal use only and may not be redistributed or resold unless the seller explicitly permits it

Disputes

AIPulse acts as a platform connecting sellers and buyers. While we facilitate transactions, the contractual relationship for each sale is between the seller and buyer. We will make reasonable efforts to mediate disputes but are not obligated to resolve them.

6. User Content and Listings

You may submit content to AIPulse, including tool listings, reviews, forum posts, and marketplace products ("User Content"). By submitting User Content, you:

• Warrant that you have the right to submit the content and that it does not infringe any third-party rights
• Grant AIPulse a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute the content in connection with the Service
• Accept that tool listings are subject to review and moderation before appearing on the platform
• Acknowledge that AIPulse may remove content that violates these Terms without notice

AIPulse does not claim ownership of your User Content. The licence granted above is solely for the purpose of operating and improving the Service.

7. Intellectual Property

The Service, including its design, code, Pulse Score algorithm, branding, and original content, is owned by AIPulse and protected by intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, except as permitted by law.

Third-party tool names, logos, and trademarks displayed on AIPulse belong to their respective owners. Their inclusion on our platform does not imply endorsement by or affiliation with AIPulse.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

AIPulse does not warrant that:

• The Service will be uninterrupted or error-free
• Pulse Scores or ratings will be perfectly accurate
• Third-party tools listed will perform as described
• Marketplace products will meet your specific expectations

Pulse Scores are generated through automated analysis and are provided for informational purposes only. They should not be the sole basis for purchasing decisions.

9. Limitation of Liability

To the maximum extent permitted by law, AIPulse and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to AIPulse in the 12 months preceding the claim, or $100 USD, whichever is greater.

This limitation applies whether the claim is based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless AIPulse and its operators from any claims, damages, losses, or expenses (including legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any third-party rights

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination include but are not limited to:

• Violation of these Terms
• Fraudulent or abusive behaviour
• Failure to pay subscription fees
• Extended inactivity (accounts inactive for over 24 months)

You may delete your account at any time by contacting us. Upon termination:

• Your right to use the Service ceases immediately
• Active subscriptions will not be refunded for the current period
• Your User Content may be removed at our discretion
• Marketplace products you have sold remain accessible to existing buyers

12. Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
